If you (“You”) continue to browse and use Eclickkart for any donations, You are agreeing to comply with and be bound by these terms and conditions (“Terms of Use”), which together with our privacy policy (“Privacy Policy”). If You disagree with any part of these Terms of Use, You may not use this Eclickkart entirely.
2.DEFINITIONS:
“Beneficiary or Beneficiarys” shall mean and include all NGO, trusts, societies, persons, individuals who run Campaigns on Eclickkart to raise donations in kind.
“Campaigns” shall mean and refer to various campaigns that run on Eclickkart for raising adequate support in kind for the Beneficiaries;
“Platform/Eclickkart” shall mean www.Eclickkart.com including its applications on mobile and/or tablet, as owned, operated and managed by Eclickkart.
“Materials” shallmean and refer to the specific material required by different Beneficiaries under their Campaigns and which shall be purchased by Eclickkart through the funds provided by You.
“Services” shall mean services provided by Eclickkart to You and the Beneficiary by facilitating connection between Beneficiaries and You so that You can donate in kind to the Beneficiary to meet the necessary objectives of charity .
“You” or “Your” or “Yourself” shall mean to the users or viewers of this Eclickkart.
3.SCOPE OF SERVICES:
Eclickkart replaces the traditional charity method of monetary donations with product donation, thus building trust and transparency for donors. Eclickkart is facilitating a connection between Beneficiaries and You, so that You can donate to the Beneficiaries as per their requirement with relevant Materials, which shall be sourced by Eclickkart. Eclickkart shall act as a platform to allow the Beneficiaries to put up and share their Campaigns to raise support for the Materials required by them.
You shall be entitled to choose the Campaigns, You wish to support and donate the Materials, by making payment of the Materials to Eclickkart on Eclickkart. Eclickkart shall purchase the Materials and donate on Your behalf to Beneficiaries.
You understand, hereby acknowledge and agree that Eclickkart or this Eclickkart does not conduct any detailed and in-depth checks on the veracity and genuineness of the Campaigns put up by the Beneficiaries. Thus, Eclickkart make no representation with respect to the genuineness of the Beneficiaries and shall have no liability to any party in relation to the transactions where Eclickkart or this Eclickkart has not been engaged or contractually involved in.
- However, Eclickkart shall ensure that :
- all the Materials donated by you shall be of a reasonable quality; and
- sourced at prices conveyed on Eclickkart; and
- delivered to the Beneficiaries, intimation whereof shall be sent to you.
Change in products being delivered after the campaign- At Eclickkart, We strive hard to deliver the exact products donated by the Donors to the Campaigner. However due to market conditions, We have to make changes in the products being delivered to the campaigner. We make sure that the Campaigner receive the same worth of products that they received earlier as well.
Some of the reasons why there will be change in the products that get delivered-
As most of the campaigns run for over a month, Prices get fluctuated and we either have to send more or less than the quantity obtained depending on the price at the time of purchase
We work with a lot of vendors across India and as we only process the order once the donation comes, Many times the vendors will go out of stock of few products and we have to replace them with other items after consulting the campaigner
Campaigner receive products from other source and they want to use the donated money for other critical products
Whatever changes we make in the campaign we make sure that we deliver the same worth of products to the Campaigner.
4.SERVICES DESCRIPTION:
The Services are subject to the limitation to these Terms of Use. The Services are also subject to EClickKart’s Privacy Policy. Eclickkart may discontinue or revise any or all other aspects of the Services at its sole discretion.
The Services provide features that exist for the ultimate benefit of the Beneficiaries and allow you to meet donate easily online. Considering the larger objective of donations reaching the Beneficiaries, You agree that as soon as You participate in a Campaign and donate Materials, You shall become a Backer for the Campaign and Beneficiaries shall have access to the Details provided by You. In case You do not wish to become a known Backer, You shall be entitled to be an anonymous Backer. Please consider carefully what You choose to share or make public, Eclickkart has no responsibility for that activity.
5. PAYMENT FOR MATERIALS:
The consideration/payment for Materials shall be made by You through the payment gateway channels and Eclickkart shall purchase the Materials ordered by You and thereafter donate the Materials on Your behalf to the Beneficiaries. Relevant photographs of donations made shall be sent to you by the Beneficiaries. No fees/consideration/payment of any sort is charged from the Beneficiaries to put up their Campaigns on Eclickkart.
As a guest, You can navigate and browse but cannot avail any Services. For availing Services, You need to register on Eclickkart. You shall be required to register and then we shall create your account with user ID and Password for availing the Services. You need to provide us Your name, date of birth, address and any other details as required by Eclickkart from time to time.
You agree that any registration information provided by You shall always be accurate, correct and complete. If You use the Services, You shall be responsible for maintaining the confidentiality of Your Account and password and You agree to accept responsibility for all activities that occur under Your Account. Eclickkart reserves the right to change or amend these Terms of Use from time to time, without any prior notice to You. We also reserve the right to refuse registration of, or cancel, accounts which we deem inappropriate.
6.BENEFICIARY INFORMATION:
Beneficiary’s are required to submit and share their details and necessary documents on this Eclickkart (“Details”), as may be required by Eclickkart, from time to time, of their trust/society/ NGOs/ institutions/ establishments/companies/organizations for verification purposes. Eclickkart may authenticate these Details as part of its check or otherwise.
However, Eclickkart takes no responsibility of the genuineness or veracity of the Beneficiaries, though in good faith, Eclickkart believes in the Campaigns run by the Beneficiaries and does a preliminary check of the information provided by Beneficiaries. Eclickkart also does not charge any fees/commission/payment from the Beneficiaries.
7.CONTENT AVAILABLE:
You acknowledge that Eclickkart does not make any representations or warranties about the Campaigns, Beneficiaries, Material, data, and information, such as data files, text, facts and figures, Beneficiarys details, computer software, code, audio files or other sounds, photographs, videos, or other images (collectively, the “Content”) which You may have access to on Eclickkart as part of the Services, or through Your use of this Eclickkart. Under no circumstances, Eclickkart is liable in any way for any Content, including, but not limited to any infringing Content, any errors or omissions in Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, transmitted, linked from, or otherwise accessible through or made available via Eclickkart.
You agree that You are solely responsible for Your reuse of Content made available through Eclickkart.
8.CONTENT SUPPLIED BY YOU:
You represent, warrant, and agree that no Content/Details shared by You with Eclickkart (“Your Content”), violates or infringes upon the rights of any third party, including copyright, trademark, privacy, publicity, or other personal or proprietary rights, breaches or conflicts with any obligation, such as a confidentiality obligation, or contains libellous, defamatory, or otherwise unlawful material.
You grant us a personal, limited, revocable, non-transferable and nonexclusive right to use the Content and Details including but not limited to Trademarks, Service Marks, logos etc. submitted by You for providing the Services, You also grant us the right (i) to display Your Contents and Details on Eclickkart (ii) promote or distribute it for the access of other Beneficiaries.
9.LINKS TO THIRD PARTY SITES:
This Eclickkart may contain links to other websites owned and operated by Beneficiaries or to any third parties who are not related to (“Linked Websites”). The Linked Websites are not under the control of Eclickkart and Eclickkart is not responsible for the content of any Linked Websites or any hyperlink contained in a Linked Website and makes no representation or warranty with respect to the content of any such third party sites.
Eclickkart provides these links to You as a convenience only and the inclusion of any link does not imply any endorsement of the Linked Website by Eclickkart. Your link to any such Linked Website is entirely at Your own risk. Eclickkart is not a party to any transaction between You and a Linked Website. Your use of a Linked Website is subject to the terms and conditions of that site.
Eclickkart may also contain third party advertisements, if any. 10.ACCESS TO ECLICKKART:
The Services offered by Website are not available to minors under the age of eighteen (18) for any reason whatsoever.
Registration: You agree to (a) only provide accurate and current information about yourself, (b) maintain the security of Your passwords and identification, (c) promptly update the email address listed in connection with Your account to keep it accurate so that we can contact You, and (d) be fully responsible for all uses of Your account. You must not set up an account on behalf of another individual or entity unless You are authorized to do so.
Using of the Services on Eclickkart does not deem to grant you any right on Eclickkart and does not make You a permanent member, shareholder or affiliate of Eclickkart for any purposes whatsoever, nor shall You have any of the rights of statutory members of Eclickkart.
11.PROHIBITED CONDUCT:
You agree not to engage in any of the following activities:
Violating laws and rights:
You shall not (a) use Eclickkart for any illegal purpose or in violation of any local, state, national, or international laws, (b) violate or encourage others to violate any right of or obligation to a third party, including but not limited to, by infringing, misappropriating, or violating intellectual property, confidentiality, or privacy rights.
12. RETURN Policy –
Delivery of the products will be done either at the end of the campaign (or) once the campaign reaches its goal. Vendor ships the products directly to the beneficiaries and we take utmost care in product quality. Once products are delivered then they can’t be returned. If there is any damage during transit then products can be replaced after vendor’s confirmation.
13. REFUND Policy-
Money once paid for the products can’t be refunded. However, if the campaign is stopped by Eclickkart if the campaigner is not following our terms, then the money will be refunded back to the user.
